  • Rwanda: A genocide survivor, Kizito Mihigo sentenced to 10 years over ‘terrorism’

    Kigali Friday 27/02/2014: A well-known Rwandan singer and a genocide survivor  Kizito Mihigo, has been sentenced to ten years in prison by a high court in Kigali for his alleged involvement in a conspiracy to murder government officials including President Paul Kagame.

    Mihigo has been on trial for nearly a year along with three co-accused on charges including conspiracy to murder and complicity in a terrorist act. Mihigo was abducted for several days before the police officially recognize his detention.

    This is a politically- motivated trial, said Emmanuel Rugira, a genocide survivor himself. Kizito was pressured to confess after being tortured in police custody, added  Rugira.  Other survivors, we contacted in Kigali could not comment as they fear for their life.

    His co-accused who include Jean Paul Dukuzumuremyi was handed 30 years in prison.
    The other accused Cassien Ntamuhanga, a journalist was sentenced to 25 years while the Agnes Niyibizi was acquitted. Kizito looked crestfallen after the ruling, observed Great lakes Voice, an online newspaper
    Before his arrest in April last year, the singer had won millions of fans because of his songs concerning unity and reconciliation. He would also appear more often at state functions, singing the national anthem right in front of the head of state and other high ranking dignitaries.
    A genocide survivor and a man with a strong church background, Mihigo, 33, commanded a huge following, young and old. The tribunal rules that Kizito committed all the charges through the instant messaging conversation he had on Skype and WhatsApp. Many Rwandans, however, remained skeptical of the entire trial.     A judge at Nyarugunga Primary Court yesterday ordered the Kigali Bar Association to avail Genocide suspect Emmanuel Mbarushimana, the full list of lawyers signed by the association’s head.

    Extradited from Denmark earlier this month, Mbarushimana, 51, rejected his initial lawyer during his appearance before the court in Kicukiro District, claiming he was an amateur.

    He subsequently requested for a list of all the lawyers who subscribe to the Bar, a request the judge granted.

    “The list I got from prosecution has 530 lawyers yet I am informed that there are 890 accredited lawyers. Secondly, the list is not signed by the president of the association,” Mbarushimana said.

    Mbarushimana, who was in the dock without a legal representative, added; “Maybe the prosecution sent me the list in good faith but I want to be sure that I have the right list of lawyers.”

    Delaying tactics

    In response, Prosecutor Ndibwami Rugambwa said the court had instructed his office to facilitate Mbarushimana get the list which they did.

    “When Mbarushimana first appeared in court, he asked for four months to prepare his defence. What he is doing is buying time to have his case drag on for four months. It is not our responsibility to get him a lawyer. We only acted on a court order,” Rugambwa said.

    After the deliberations, presiding Judge Felix Ndahigwa, ruled that the suspect be given a full list of all accredited lawyers not later than July 28.

    “After getting the list, you will have 15 days to pick a lawyer of your choice and prepare for the pretrial which will resume on August 12,” Ndahigwa told the suspect.

    The defendant requested for legal aid and his lawyer is supposed to be paid by government through the Ministry of Justice.

    However, the Rwanda Bar Association says Mbarushimana was provided with a competent lawyer and that if he rejected him, he would have informed the Bar officially.

    “Our membership is in the public domain. We shared it with the concerned authorities including the Ministry of Justice and the courts,” said Victor Mugabe, the executive secretary of Kigali Bar Association.

    He added; “We have a total of  1,074 accredited lawyers but not all of them are competent to try cases transferred from other jurisdictions. We have a list of competent lawyers we agreed on with the International Criminal Tribunal for Rwanda and the lawyer he rejected was on that list.”

    Mugabe, however, wondered why person would ask for legal aid and go further to dictate on the kind of  lawyer he wanted.

    It is alleged that in 1994, Mbarushimana organised and participated in the killings of Tutsi in Kabuye, Dahwe, Gisagara, Ndora, Twarubona and nearby areas, in the current Gisagara District in the Southern Province.  He was, at the time, an Inspector of Schools in then Muganza Commune.

    The former schoolteacher had lived in Denmark with his wife and children for the last 13 year before he was extradited.

  • Karwera arrêtée en France pour génocide

    Kigali: Mme Sperancie Karwera Mutwe, suspectée de génocide, a été arrêté à Cergy en  France  selon une lettre de l’Ambassade du Rwanda à Paris adressée à l’Autorité des poursuites pénales du Rwanda (NPPA, National Public Prosecution Authority).

    Sperancie Karwera Mutwe a été arrêtée sur base d’un mandat d’arrêt international émis le 26 novembre 2004 par le Rwanda qui la recherche pour son rôle présumé dans le génocide des Tutsi du Rwanda en 1994.

    Selon cette lettre, le Ministère français des Affaires étrangères demande à Kigali de fournir les documents officiels et requêtes nécessaires pour l’extradition de Sperancie Karwera Mutwe afin qu’elle soit jugée au Rwanda où les crimes ont été commis.

    Sperancie Karwera Mutwe a été conseillère principale au Ministère rwandais des Affaires étrangères pendant le génocide de 1994. (Fin)

    About 358 genocide survivors were screened for free plastic surgery on minor and major scars during a ten-day exercise dubbed; “The 2013 Rotary Medical Mission to Rwanda for Plastic Surgery” at the Central University Hospital of Kigali (CHUK).

    Of these, 74 were treated for scars inflicted by major injuries, 68 for minor injuries, while 54 were counseled and sent back home, according to Theobald Hategekimana, the director of CHUK.

    The free plastic surgery was offered by visiting Indian and Nigerian surgeons courtesy of Rotary Medical Mission.

    “A number of those who received operations for major scars are going to be in hospital for between 10 to 14 days as we continue to monitor them but most of them have already gone home,” Dr Hategekimana said.

    Rajendra Saboo, who led eight surgeons and seven volunteers, said they were privileged to respond to the request by the Minister for Health. He they carried out the operations to their best.

    “This is my second time in Rwanda and we have developed a special relationship with the country,” Saboo said.

    Dr Agnes Binagwaho, the Health minister, said Rwandans are not prisoners of their past and those with physical scars should have a chance to get the them fixed.

    “We have to work together and help the affected recover,” said Binagwaho.

    Beransira Bagirinka, a 73-year-old Bugesera resident who sustained burns during the 1994 Genocide against the Tutsi, received a skin graft operation.

    She said she is among the luckiest people in the world and thanked the doctors for a job well done done.

    “These people have wiped away my tears, God bless them and Rwanda,” she said.

    A 37-year-old man was on Tuesday referred to a Dutch court for a hearing that will determine whether he will be extradited to face trial for his role in the 1994 Genocide against the Tutsi.

    A statement from Dutch prosecutors said Jean-Claude Iyamuremye was arrested on an extradition request filed by the Rwandan prosecution.

    Iyamuremye, a.k.a, Nzenga, is accused of being part of the militiamen who attacked and killed Tutsis who had sought asylum at the former ETO-Kicukiro, after they were abandoned by UN forces. The victims are said to have made the widely known “way of cross” trekking to Nyanza hill, where they were killed.

    According to the indictment, Iyamuremye is accused of genocide, war crimes, crimes against humanity and torture.

    Dutch prosecutors said it was important that Iyamuremye is tried where he is accused of committing the crime.

    “This is where the evidence is, where legal professionals are best acquainted with the language, culture and backgrounds of the events and where usually most victims and relatives reside,” reads the statement.

    The extradition request will be examined next week by the Court of First Instance in The Hague.

    Reason of hope

    In Kigali, the National Public Prosecutions Authority spokesperson said it is too early to comment on the case.

    However, a Genocide survivor living in the Netherlands said the proceeding was a sign of hope.

    Among the cases tried in the Netherlands include that of Yvonne Basebya, who was earlier this year sentenced to six years for inciting genocide.

    Also,  in 2009, a Dutch court sentenced Joseph Mpambara to 20 years for his role in the 1994 Genocide. He appealed and, in July 2011, the higher court sentenced him to life in prison for war crimes committed in Rwanda in 1994.

    The most important message, sources in the Netherlands said, is that the kingdom no longer wants to be a haven for suspected genocidaires.

    Ibuka Executive Secretary Naphtal Ahishakiye welcomed the momentum in the Netherlands, saying it should be emulated by other European countries harbouring Genocide suspects.

    Ibuka is the umbrella organisation for Genocide survivors.

    “Ibuka is encouraged and happy about the noticeable effort in the Netherlands to bring to book the people who are responsible for the deaths of a million of innocent lives,” Ahishakiye said.

    “Also laudable is the fact the Dutch have recognised that Rwanda’s justice system is fair and efficient. We thank them and urge them to continue in their current path.”

  • No matter how long it takes, Genocide victims will get justice

    This is with reference to Felly Kimenyi’s column, “Time up for the unending French court drama on matters of Genocide”, in The New Times of September 19.

    Lest anyone forget, the Bagosora-Sindikubwabo-Kambanda genocidal interim government was established at the residence of the then French Ambassador in Kigali (in 1994).

    How can anybody, knowing this level of intimacy between the genocide linchpins and the French authorities expect justice from France as it concerns very close allies?

    France’s close role in the 1994 Genocide against the Tutsi completely disqualifies Paris from dispensing justice on this issue, as well as pronouncing on anything related to any genocide, mass atrocities anywhere or the question of human rights. They are too complicit in the Genocide that anything they say on such issues comes out sounding as an obscenity.

    They would be laughed at outright if they dared to assume the moral high ground in matters related to human rights were it not for the fact their fellow Westerners never criticise each others’ crimes against humanity and other mass atrocities in which they are complicit.

    This, however, makes the rest of humanity see them all as the hypocrites they all are every time they lecture others on matters of human rights. Their silence on France’s role in the 1994 Genocide against the Tutsi – akin to the same country’s similarly culpable role in the Shoah (Holocaust) – fatally disqualifies them as lesson-givers.

    A certain country doing this or that should not discourage witnesses of the 1994 Genocide against the Tutsi to continue denouncing and revealing the atrocities of the actors of the Genocide.

    As a certain person I respect much usually says, “The truth should always be told, even when those against it may be many”.  It is the same reason why those who committed the Holocaust against the Jews are still hunted down to date.

    If the world was fair with itself, the 1994 Genocide against the Tutsi would be a global affair.

    We are all humans. If I do wrong my own brother should be the first one to denounce me if at all I don’t denounce myself for my own sake in particular and the community in general.

    But some people prove to be harder than a rock to hide Genocide in their hearts for 20 years and still counting.
